Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code, Section 40(1-a), 21(i) of D.E. Act (Damage to Property Act), Section 40(1) of Bihar Minor and Minerals Act and Sections 33, 41, 42 of Forest Act.
Petitioner happens to be owner of the dumper in question and the stand of the petitioner is that being transporter petitioner got loaded stone chips on his dumper which had to be unloaded at Hasan Bazar but while dumper was going towards Hasan Bazar, on the way informant stopped the dumper and demanded illegal money which was refused resulting institution of
Patna High Court Cr.Misc. No.29632 of 2016 (2) dt.26-07-2016 2/2 the present case. Petitioner is in jail custody since 06.06.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Rohtas at Sasaram in connection with Nokha P.S.
