JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-09-2015 The present application under Section 482 of the Code of Criminal Procedure has been filed seeking quashing of the order dated 22.10.2014 passed in Cr. Revision no. 62 of 2014 by the learned Adhoc Additional Sessions Judge No. VIII, Purnia whereby revision against the order dated 16.1.2014 passed in Case no. 18M of 2014 by the learned S.D.M., Dhamdaha, initiating a proceeding under Section 107 of the Code of Criminal Procedure against the petitioners and opposite party nos. 2 to 6, has been dismissed.
Though the instant application has been filed under
Patna High Court Cr.Misc. No.1371 of 2015 (2) dt.03-09-2015 2 / 2 Section 482 of the Code of Criminal Procedure, the same is in the nature of second Revision which is barred under Sections 397(3) and 399(3) of the Code of Criminal Procedure. Even otherwise, I do not find any irregularity or illegality in the impugned order dated 22.10.2014.
Accordingly, the application is dismissed.
