11-06-2019 Heard Sri Mahendra Thakur, learned counsel for the petitioner. None appeared on behalf of State. The sole petitioner, who is in custody since 22-02-2019, as stated in paragraph - 11 of the petition, in Desri (Chandpura O.P) P.S. Case No. 49 of 2019 registered for offence under Sections 379, 411/34 of the Indian Penal Code, has prayed for grant of bail.

At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. He further submits that one of the co-accused namely Deepak Kumar, who was apprehended alongwith the petitioner, has already been granted bail by a coordinate Bench of the Court by order dated 30-05-2019 passed in Cr. Misc. No. 35446 of 2019.

No.36160 of 2019(2) dt.11-06-2019 2/2 In view of nature of accusation, clean antecedent as well as the fact that one of the co-accused has already been granted bail, let the petitioner namely Gopi Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-2, Vaishali at Hajipur in connection with Desri (Chandpura O.P) P.S. Case No. 49 of 2019.
