The petitioner is languishing in custody since 07.12.2012 in connection with Sessions Trial No. 124 of 2014, arising out of Jandaha P.S. Case No. 227 of 2012 for the offences instituted under Sections 302/34 of the IPC and 27 of the Arms Act. The prosecution story, in brief, is that while the informant's younger brother went to morning walk, three unknown persons came on a motorcycle and surrounded him. The person who was sitting in the last as a pillion rider, fired at him which hit him in his chest as a result of which he died. Thereafter the miscreants fled away.

Patna High Court Cr.Misc. No.29998 of 2016 (4) dt.23-09-2016 2/2 Earlier bail applications of the petitioner have been rejected by the High Court as well as by the Hon'ble Supreme Court.

A report was called for from the court below regarding the stage of the case. It has been reported that the prosecution evidence has been closed and the case is posted for defence evidence.

Considering the aforesaid facts and circumstances and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in Sessions Trial No. 124/2014, arising out of Jandaha P.S. Case No. 227 of 2012, pending in the court of the learned Sessions Judge, Vaishali at Hajipur.
