JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Programme Manager is apprehending arrest in a case registered for the offences punishable under Sections 420, 409, 467, 468, 504, 120B of the Indian Penal Code.
It is alleged that Suresh Prasad, Panchayat Mukhiya of Itasagar Gram Panchayat took signature of the informant on some papers and photographs for preparing job cards under MANREGA scheme and on the basis of same, job card was prepared and an account was opened at Sijhori Post Office and on the basis of forged attendance of the informant and one Sitwa Devi, the amount was withdrawn. It is alleged that the Panchayat Mukhiya committed forgery in league with the petitioner. It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.23388 of 2015 (2) dt.07-07-2015 2/2 the petitioner has no role in preparation of job card and withdrawal of amount of the labourers under the MANREGA scheme. Moreover, co-accused Sabir Ahmad and Rajesh Kumar have been granted anticipatory bail vide Cr. Misc. Nos. 8383 of 2015 and 21178 of 2015.
Considering the fact that the thrust of accusation is against the Panchayat Mukhiya, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Jamui in connection with Sikandra P.S. Case No. 130 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
