The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 325, 308, 504, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner nos. 2 and 3 are young boys aged about 19 and 18 years respectively and the informant alleges that on 23.04.2022 while he was taking rest at his home, the accused persons, including the petitioners, came variously armed and abused and assaulted him
Patna High Court CR. MISC. No.42110 of 2022(2) dt.27-09-2022 2/3 and his wife causing injury, accordingly they were brought to doctor in a senseless condition.
Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case, it is next submitted that the allegation of assault and abuse are general and omnibus in nature, it is also submitted that after the occurrence, a Panchayati was convened and the informant alleges that the accused persons did not obey the dictate of the Panchayat as such the present FIR came to be instituted, it is next submitted that the injury suffered is also simple in nature and similarly situated co-accused 'Meena Devi' has been granted bail by order dated 14.09.2022 in Cr. Misc. No. 34913 of 2022.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where
