The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 341, 302, 307, 323, 504 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation against the petitioner is of causing injury on the leg of the brother of the deceased. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.03.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. As per the First Information Report, the petitioner is said to have caused injury on the leg of the brother of the deceased, which is non-vital
Patna High Court Cr.Misc. No.33212 of 2016 (3) dt.22-09-2016 2/2 part of the body. There is no allegation of causing injury upon the deceased. Subsequently, in course of investigation, number of witnesses in para-8, 9 and 10 of the case diary have stated that the deceased and his brother both were caused injury by co-accused Sanjeev Anand.
On behalf of the state it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Sitamarhi, in connection with Majorganj P.S. Case No. 55 of 2016.
