The petitioner seeks bail in Barahara P.S. Case No. 288/2016, registered for the offence punishable under Section 414 of the Indian Penal Code.

The police raided the house of Rabi Mahto and on his confession, the police also raided the house of the petitioner, from where a box in which some frocks (girls garment), ladies purse containing Rs. 13,000/- etc. were recovered.

Learned counsel for the petitioner submits that no case of theft is reported anywhere. Girls garment were purchased by the petitioner for his family members. The petitioner is in jail since 25.09.2016.

Considering the facts aforesaid and the fact that

Patna High Court Cr.Misc. No.9933 of 2017 (2) dt.06-03-2017 petitioner has already remained in jail for more than five months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Barahara P.S. Case No. 288/2016.
