JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 This is an application for grant of anticipatory bail in connection with Ara P. S. Case No. 621 of 2018, disclosing offences under Sections 304B, 34 of IPC and Section 3⁄4 of Dowry Prohibition Act.

Case is under Section 304B of IPC. Petitioners happens to be the in-laws of the deceased.

Submission of the learned counsel for the petitioners is that nothing has been attributed against them, rather the materials collected during the investigation disclosed that she was suffering from illness and she was taken to hospital by the

Patna High Court CR. MISC. No.36352 of 2019(4) dt.18-09-2019 2/2 mother-in-law and husband of the deceased, where she died. Information to the same was given to the informant and others. It has further been submitted that even in the postmortem report cause of death could not be ascertained and viscera report is preserved.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Ara P. S. Case No. 621 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
