JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-01-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 302 and other allied sections of the IPC and section 27 of the Arms Act.

As per the prosecution case, petitioner and two other co-accused persons opened fire causing death of Baiju Yadav and Prikshan Yadav.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to land dispute. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 29.6.2019.

Learned counsel for the State opposes the prayer for bail and submits that it is a double murder case and prayer for bail of the petitioner was earlier rejected by a co-ordinate bench this Court and the trial court's report dated 13.12.2021 reveals that the case is running for recording of prosecution witnesses.
