JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with K.Hat Police Station Case No. 192 of 2015 registered for the offences punishable under Sections 147, 148, 341, 323, 504, 506, 467, 468, 120 B, 379, 364, 384, 386 of the Indian Penal Code and 27 of the Arms Act.
It would appear from perusal of the first information report that co-accused Ramu Murmu is said to have defalcated some amount for which petitioner was his guarantor and has given two cheques to the informant but when the aforesaid cheques were produced before the concerned bank, the same got bounced.
Patna High Court Cr.Misc. No.26177 of 2015 (2) dt.16-07-2015 2/2 Subsequently, it is stated that petitioner and others forcibly took the signature of the informant on plain paper putting him into fear of death.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in K.Hat Police Station Case No. 192 of 2 015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
