JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being the headmaster of a school withdrew Rs.10 lacs and odd in advance for construction of school building but petitioner did work to the tune of Rs. 7,51,506/- till the institution of the F.I.R and accordingly, it is alleged that petitioner defalcated Rs. 2, 53,704/-.

Learned counsel for the petitioner submits that the first information report was lodged on 22.01.2016 but on 05.07.2016 when the informant visited the school, he found that the work of his school building was almost completed except plaster as well as white washing, which is evident from perusal of Annexure-2 to this petition.

Patna High Court Cr.Misc. No.36241 of 2016 (2) dt.23-08-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S.Case No. 13 of 2016.
