23-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Semra P.S. Case No. 70 of 2021, registered for the offence under Section 414/34 of the Indian Penal Code.

As per F.I.R., this petitioner was apprehended with a stolen motorcycle.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to village politics and on the basis of confessional statement of co-accused Bishnu Kumar. No stolen motorcycle has been recovered from the possession of the petitioner. Petitioner has got clean antecedent and he is in custody since 28.06.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Semra P.S. Case No. 70 of 2021.
