2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 376, 342, 323, 504, 506, 34 of the Indian Penal Code and section 4 of the POCSO Act.

3. As per the prosecution case, petitioner is alleged to have committed rape with the informant.

4. It is submitted that petitioner has been falsely implicated in this case. There is inordinate delay in lodging of the FIR for which no plausible explanation has been given. Petitioner claims clean antecedents.

5. Counsel for informant however, vehemently opposed the prayer for bail and submitted that the victim girl in her statement under Section 164 Cr.P.C has duly supported the

Patna High Court CR. MISC. No.40358 of 2023(2) dt.01-08-2023 2/2 prosecution case.

5. Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Parsauni P.S. Case No. 68 of 2022. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
