2. The petitioner is in custody in connection with Cyber P.S Case No. 66 of 2025 registered for the offences punishable under Sections 75, 77, 78,79, 356(2), 352, 351(3), 341(4) of the Indian Penal Code.

3. As per allegation in the FIR, allegation against the petitioner is that he has established physical relationship with one Khusbu Kumari and took photograph of intimate moments and made it viral on social medial.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that informant is a lady of cruel behavior and suspicious character due to reason of which the informant, only after few

Patna High Court CR. MISC. No.39853 of 2025(3) dt.10-09-2025 2/3 months of her marriage was got separated with her husband namely Chandan Kumar who is cousin brother of the petitioner. He further submits that alleged photographs which has been made viral is not from the petitioner's social media account rather it has been done from the informant's social media account itself. He further submits that informant and petitioner was in relationship and whatsoever act been committed between them were with consent of each other. He next submits that petitioner is in custody since 16.03.2025 having clean antecedent.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner and submits that petitioner has publicly posted obscene photograph of the victim which malign her image in society and this is a serious offence.

On perusal of the FIR, case diary and impugned order dated 17.05.2025, it appears that petitioner is involved in the commission of the alleged crime which is apparent from the photographs attached with the FIR. Further from perusal of para 6, 7 and 9 of the case diary, the case have been found true against the accused petitioner. So, considering the serious nature of allegation leveled against the petitioner, this Court is not inclined to enlarge the petitioner on bail.

7. Accordingly the prayer for regular bail of the petitioner is hereby rejected.
