The petitioner seeks regular bail in connection with Special Case No. 3243 of 2019 arising out of Nadi Police Station Case No. 78 of 2019 registered for the offences punishable under Section 30(a) of the Bihar Prohibition &Excise Act, 2016.

The allegation is regarding recovery of 80 litres of illicit liquor from a car.

The learned counsel for the petitioner submits that the petitioner is neither the occupant of the car nor the driver of the car and he is a simple labourer, who was arrested merely on suspicion of being carrier of illicit liquor. It is submitted that though the petitioner is accused in one other case but he is on

Patna High Court CR. MISC. No.45565 of 2019(3) dt.17-08-2019 2/2 bail in the said case. Lastly, it is submitted that the petitioner is languishing in custody since 24.03.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna in connection with Special Case No. 3243 of 2019 arising out of Nadi P.S.
