ANJANA MISHRA ORAL ORDER 07-05-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Narpatganj P.S. Case No. 117/2014 registered for the offences punishable under Sections 447/341/323/324/379/504/506/34 of the Indian Penal Code.
Petitioners No. 2 and 7 have already been taken into custody as such the prayer for bail has become infructuous and, accordingly, dismissed as withdrawn.
Having considered the submissions of learned counsel for the petitioners and after perusing the materials available on
Patna High Court Cr.Misc. No.49463 of 2014 (2) dt.07-05-2015 record, let the petitioners, 1, 3, 4, 5, 6 and 8, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Araria in connection with Narpatganj P.S. Case No. 117/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. So far as petitioner No. 9 Md. Riyaz is concerned, noting the fact that there are several cases pending against him, I am not inclined to grant him anticipatory bail. It is, accordingly, rejected. However, if he surrenders before the Court below his prayer for bail may be considered on the same day without being prejudiced by the present order.
