The petitioner seeks bail in Durgawati P.S. Case No. 24/2017, registered for the offences punishable under Sections 30(a), 38 of the Bihar Prohibition & Excise Act, 2016. The petitioner was coming on motorcycle, but after seeing the police, the petitioner fled away after leaving the motorcycle. On search, 26 litres of 'Masaledar' liquor was recovered from the motorcycle for that the petitioner is in jail since 06.02.2017.

It is submitted that petitioner remained in jail for one and half months and he has got no criminal antecedent. Considering the facts aforesaid, the petitioner above-
