The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 47a of the Excise Act.

It is alleged that 18 bottles of country made and foreign liquor were recovered kept in the betel shop of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner was not present at the place of seizure. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

No.25810 of 2015 (2) dt.17-07-2015 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Nirmali P.S. Case No.42 of 2015, pending before the learned Judicial Magistrate, Supaul. With the above observation, this application is, accordingly, disposed off.
