Petitioner seeks bail in a case registered under Sections 406, 420, 120B of Indian Penal Code and Section 138 of Negotiable Instruments Act.

Learned counsel for the petitioner submits that the cheque in question is of Bonanza Port Folio Company Limited. The petitioner is an employee of the said Company. It is further submitted that the allegations are false and the cheque in question dated 20.04.2016 is in respect of a period when the petitioner was already in custody. It is also submitted that the petitioner had no intention to cheat the Company or the informant in any manner and he has been implicated in many cases of the similar nature. In

Patna High Court Cr.Misc. No.16385 of 2018 (4) dt.27-04-2018 2/2 another case of similar nature, he has been allowed bail by this Court in Cr Misc No 22637 of 2017. In this case, he is in custody since 09.09.2016.

In the light of the aforesaid submissions, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Sasaram in Kochas Police Station Case No 110 of 2016 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
