The petitioners apprehend their arrest in a case registered for the offences punishable under Section 323, 307, 354B, 420, 498A, 312, 313, 504 & 506/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Petitioners, who are mother-in-law and brother-inlaw of opposite party no.2, is said to have ousted the opposite

Patna High Court CR. MISC. No.49546 of 2021(2) dt.26-04-2022 2/2 party no.2 from her matrimonial home in association of their family members over the dowry demand.

It is submitted by learned counsel for the petitioners that the petitioner are innocent person and have committed no offence. Petitioners have neither made any dowry demand nor drove her out of her matrimonial home nor tormented her over the demand of dowry. They are mother-inlaw and brother-in-law of opposite party no.2 and are living separately with her. She is living with her husband and they have no concern with her day to day affair. They have no criminal antecedent.

In that view of the matter, let the above named petitioner, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Complaint Case No.431 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
