JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Begusarai Town P.S. Case No.112/15 registered for the offence under Sections 302, 120(B)/34 of the I.P.C. and Section 27 of the Arms Act. As per written report, altogether eight persons came on motor cycle and fired on the husband of the informant who succumbed to his injuries.
It has been submitted on behalf of the petitioner that he is not named in the F.I.R. His name has come merely on suspicion. No test identification parade has been held in this case till date.

Patna High Court Cr.Misc. No.11756 of 2017 (3) dt.01-05-2017 2/2 granted bail by a coordinate Bench vide order dated 15.03.2017 passed in Cr.Misc. No.52858/16.
Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, in Begusarai Town P.S.
