JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 337, 307, 427, 436 and 504/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act. It is alleged that since the she-goat of the informant grazed vegetable crop of the accused persons, accused persons including the petitioner assaulted the informant and one Gurucharan Bhiyan and also abused by calling caste name. It is also alleged that the accused persons put the house of the informant on fire.

It is submitted by learned counsel for the petitioner that the injury of the informant has been found to be simple in nature and during investigation, it was found that the fire was lit by the

Patna High Court Cr.Misc. No.13468 of 2015 (2) dt.08-05-2015 2/2 co-accused Sarswati Devi. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Baghaila P.S. Case No. 56 of 2014 pending in the court of learned JM, 1st Class, Sasaram, Rohtas. Accordingly, the application is disposed of.
