JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-03-2021 This case has come at the instance of the office that by order dated 05.03.2021, this Court had granted bail to the appellant with certain conditions and had also directed the Court Master to keep the statement under Section 164 Cr.P.C. under sealed cover and return it to the Registry for it to be transmitted to the court below. It has been pointed out that aforesaid 164 Cr.P.C. statement was taken out from the records of Cr. App (SJ) No. 3918 of 2019 which is still pending disposal before another Bench.

In that view of the matter, the direction of this Court for sending back the statement be not given effect to till the time the Cr. App (SJ) No. 3918 of 2019 is disposed of.

The appellant, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional District & Sessions Judge -cum- Special Judge (S.C./S.T./POCSO), West Champaran at Bettiah in connection with Lauriya P.S. Case No. 77 of 2019. The conditions imposed in the order dated 05.03.2021 shall subsist.
