JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was employee and his duty was to carry cash up to the A.T.Ms and it is alleged that on the alleged date of occurrence when dacoity took place, petitioner did not come to rescue the informant. The claim of the petitioner is that he was on leave on the alleged date of occurrence but when the boss of the petitioner was asked regarding the same, he stated that petitioner had not taken leave on the alleged date of occurrence. It appears that there is only allegation of hatching conspiracy against the petitioner, who does not have any criminal antecedent and is languishing in jail custody since 14.06.2014.
Patna High Court Cr.Misc. No.34414 of 2016 (2) dt.20-08-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Samastipur in connection with Mohiuddin Nagar P.S.Case No. 102 of 2016.
