JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 09.07.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kumarkhand P. S. case no. 189/2014 registered under sections 419, 420, 467, 468 and 471 of the Indian Penal Code. The accusation against the petitioners is that they applied for loan attaching forged khatiyan, rent receipts but submission on behalf of the petitioners is that petitioners had never applied for any loan and, as a matter of fact, some mischievous persons had given the aforesaid petition in the name of the petitioners. It is further contended by him that moreover, having similar allegation, co-accused Arun Kumar Nishad has already been granted privilege of anticipatory bail by coordinate bench of this court.

No.22838 of 2015 (2) dt.09-07-2015 Accordingly, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in Kumarkhand P. S. case no. 189/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
