The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It is alleged that all the accused persons including the petitioner assaulted the family members of the informant and specific allegation against co-accused Shrawan Yadav that he assaulted with Garasa on the head of the son of the informant who subsequently succumbed to the injuries during treatment. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the final form has been submitted in favour of the petitioner but cognizance has been taken by the trial

Patna High Court CR. MISC. No.49534 of 2021(2) dt.30-03-2022 2/2 Court after finding the prima facie case. He further submits that similarly situated co-accused persons have already been granted anticipatory bail by this Court passed in Cr. Misc. No. 17265 of 2021. Petitioner has no criminal antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Alok Ranjan, Judicial Magistrate Ist Class, Jehanabad/concerned Court in connection with Trial No. 2656 of 2020 arising out of Makhdumpur P.S. Case No. 348 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
