====================================================== CORAM: HONOURABLE MR. JUSTICE PRAVEEN KUMAR ORAL ORDER 17-06-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Excise (Sadar) P.S. Case No. 458 of 2026 dated 20.03.2026 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, the petitioner was found driving auto-rikshaw from which altogether 113.940 liters of foreign liquor has been recovered.

4. Learned counsel for the petitioner submits that the petitioner is the driver of the auto-rikshaw in question from which the alleged recovery has been made. It has further been submitted that the petitioner was not aware that the sacs, from

It has further been submitted that the petitioner has got no criminal antecedent. It has lastly been submitted that the petitioner is in custody since 21.03.2026 and the charge sheet has been filed in this case.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

6. Heard the parties and perused the records.

7. Considering the facts and circumstances of the case as well as the period of custody, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-I, Bhagalpur, in connection with Excise (Sadar) P.S. Case No. 458 of 2026.

8. The application stands allowed.
