Petitioner is apprehending his arrest in connection with Bairiya P.S.Case No.195 of 2018 , registered for offences punishable under Sections 406, 420, 467, 468, 441, 323/34 of the Indian Penal Code.
As per FIR, there is allegation against the petitioner is that under a conspiracy he got the sale deed executed from the daughter of the informant taking plea that her father is ill. Submission of the learned counsel for the petitioner is that only allegation is against the conspirator and the person who is main accused has been granted bail and other conspirators have also been granted anticipatory bail. No.38493 of 2019(4) dt.07-11-2019 2/2 informant, who has opposed the prayer for bail on the ground that he is the main person, who has taken the daughter of the informant on wrong plea and got the sale-deed executed.. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, this application is allowed and the provisional bail granted to the petitioner, vide order dated 12.7.2019 is confirmed and on surrender before the learned court below he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VII, Bettiah, District West Champaran in connection with Bairiya P.S.Case No.195 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
