The petitioner seeks bail in Vibhutipur P.S. Case No.248 of 2019 registered under Sections 272 and 273 of the Indian Penal Code and under Section 30(a) of Bihar Prohibition and Excise Act.

The police on secret information raided a place and found 336 litres of liquor kept under a water tank. Five persons are said to have fled away who were identified as Ganesh Kumar, Brajesh Kumar, Vikash Kumar(the petitioner), Raushan Kumar and Mukesh Kumar.

The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. Mukesh Kumar Singh @ Mukesh Kumar and Raushan Kumar have been granted bail by different Co-ordinate

Patna High Court CR. MISC. No.37020 of 2020(2) dt.02-02-2021 2/2 Benches of this Court vide order passed in Cr. Misc. No.12151 of 2020 and Cr. Misc. No.24615 of 2020 respectively. The case of the petitioner stands on the same footing. Petitioner is in jail since 19.07.2020.

Taking into consideration the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. II-cumSpecial Judge, Excise, Samastipur in connection with Vibhutipur P.S. Case No.248 of 2019.
