The petitioner is apprehending his arrest in a case in connection with Jamo Bazar P.S. Case No. 273 of 2020 pending in the Court of learned Chief Judicial Magistrate, Siwan registered for the offences punishable Sections 448, 341, 323, 307, 504 and 506/34 of the Indian Penal Code. It is a case of assault upon the informant by means of lathi-danda and rod by the petitioner and other accused persons. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has got clean antecedent. Learned APP appearing for the State has opposed the
Patna High Court CR. MISC. No.49777 of 2021(2) dt.30-03-2022 2/2 prayer for anticipatory bail.
From perusal of the impugned order, it appears that CT Scan of brain of injured Rakesh Kumar Singh shows that the injury on parietal region is grievous in nature caused by hard and blunt substance, so the injuries of Rakesh Kumar Singh corroborates the allegation as mentioned in the FIR and it appears from the case diary that during investigation, the witnesses have also supported the case of the prosecution, as such, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is rejected.
However, the petitioner is directed to surrender before the court below and make prayer for regular bail. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
