JUSTICE SUDHIR SINGH ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 364A/34 of the Indian Penal Code.
Allegation is that some unknown accused persons came by motorcycles and kidnapped son of the informant for ransom. It has been submitted on behalf of the petitioner that he is in custody since 23.5.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. The victim boy in his 164 Cr. P.C. statement has not named this petitioner. The victim is said to have been recovered from the house of Bimla Devi. Petitioner happens to be the son of said Bimla Devi. He is separate in mess and property from his mother. On behalf of the State, it is submitted that petitioner is not named in the F.I.R. His name has come in course of investigation.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.30595 of 2016 (3) dt.15-09-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Manjhaul, District-Begusarai, in connection with Cheria Bariarpur P.S. Case no. 84 of 2016.
