JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 This is an application for grant of anticipatory bail in connection with Khagaria Mahila P. S. Case No. 17 of 2019, disclosing offences under Sections 498A, 34 of IPC and Section 3⁄4 of Dowry Prohibition Act.
Allegation against the petitioners is of trying to kill the complainant, who is wife of co-accused Arun Yadav by setting her on fire with respect to demand of one motorcycle. Submission of the learned counsel for the petitioners is that allegations are against the seven persons and only one injury was found on her chest that appears to be simple in nature and further petitioners are ladies and they are mother-in-law, Gotini and unmarried Nanad. They are ready to abide by any condition imposed

Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, who has opposed the prayer for anticipatory bail considering the seriousness of the injuries. Having heard both sides, no doubt, there are allegation of setting the opposite party no.2 on fire, but allegation is against seven persons, considering the fact that petitioners are ladies and they are ready to abide by any condition imposed upon them, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of Shri Shammi Kujur, learned Judicial Magistrate, 1st Class, Khagaria, in connection with Khagaria Mahila P. S. Case No. 17 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that they have to appear before the police as and when required, otherwise, their bail bonds shall be cancelled.
