The petitioner seeks bail in Shahpur (Karnamepur) P.S. Case No. 243 of 2016, registered for the offences punishable under Section 395 of the Indian Penal Code.

The informant alleged that while he was returning to his house along with his brother after collecting money from his customers two persons pointed out pistol on them. At the same time 10-12 other criminals also came there and all the accused persons looted away Rs. 10 lakhs.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The police apprehended the petitioner and got his confessional statement, but nothing has been recovered from possession of the petitioner. The petitioner is said

No.12119 of 2017 (2) dt.18-03-2017 2/2 to have confessed that he also got Rs. 10,000/- as share from the looted amount, but no article was recovered from possession of the petitioner. The petitioner was not put on test identification parade although he is in custody since 03.11.2016.

Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-14, Bhojpur at Ara in Shahpur (Karnamepur) P.S. Case No. 243 of 2016.
