Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 323, 324, 379, 307, 504 of the Indian Penal Code. It is alleged that informant was carrying sand through a tractor by passing through the tractor from the passage claimed by him which was objected by petitioner No. 1 Gopal Rai when the informant protested that it is a government road then he was abused and assaulted. When Dharmendra Rai and Kaushiya Devi came to rescue then petitioner Arun Kumar, Rabindra Rai, Lallan Rai, Bhutan Rai, Balkeshiya Devi badly assaulted them with iron rod and lathi
Patna High Court Cr.Misc. No.22360 of 2015 (2) dt.07-07-2015 2/2 and took away Rs. 5000/- from the pocket of Dharmendra Rai. It is submitted by learned counsel for the petitioners that four persons received injuries from the informant's side but all have been found to be superficial, simple in nature. There is counter version of the occurrence and petitioners' side also received injuries. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Isuapur P.S. Case No. 9 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
