The petitioners are in custody in connection with Belhar P.S.Case No.369 of 2016 registered for an offence under Sections 30 and 38 of the Bihar Excise (Amendment) Act, 2016. Both the petitioners were allegedly caught by the police while they were indulged in the trade of country made wine. It is stated that some country made wine was also recovered from the house of the petitioners.

Learned counsel for the petitioners submits that both the petitioners are Santhali and they have falsely been implicated by the police. There is no antecedent against the petitioners and they have remained in custody for more than two and half months.

Patna High Court Cr.Misc. No.6019 of 2017 (2) dt.01-03-2017 2/2 Considering the nature of allegation and the facts and circumstances of the case, let the above named two petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri A.K.Gupta, Sub-Judge-III-cum-ACJM-II, Banka in connection with Belhar P.S.Case No.369 of 2016 (G.R.No.3517 of 2016).
