JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 It has been submitted on behalf of the petitioners that petitioner no. 1 has been arrested during pendency of this application and his application has become infructuous. Hence, he does not want to press this application in respect to the petitioner no. 1.

The petitioner nos. 2 and 3 are apprehending their arrest in connection with Salimpur P.S. Case No. 148 of 2013 for the offence under Sections 304B, 201/34 of the Indian Penal Code.

Heard learned counsel for the petitioner no. 2 and 3 and the State.

The prosecution story, in brief, is that the informant's daughter was married with Santoh Ram in the year 2010. On 02.11.2013 Pramila Devi informed the informant that her daughter has been absconded from the house and after

Patna High Court Cr.Misc. No.1177 of 2015 (3) dt.08-05-2015 seven days it came to know that the petitioners have committed murder of the deceased and disappeared her dead body. It is submitted on behalf of the petitioners that the petitioner no. 2 is the mother-in-law and petitioner no. -3 is debar of the deceased. It has further been contended on behalf of petitioners 3 that the petitioners have no concerned with the deceased and her husband. In fact, they are living separately from the husband of the deceased. It is further submitted that the petitioners have no criminal antecedent.

On behalf of the State, it has been submitted that the petitioners are named in the First Information Report and specific allegation has been made against them. Considering the aforesaid facts, let the above named petitioner nos. 2 and 3, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Barh at Patna in connection with Salimpur P.S. Case No. 148 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
