BAJANTHRI ORAL ORDER 24-01-2022 The matter is heard via video conferencing due to circumstances prevailing on account of Covid-19 pandemic. State counsel accepts notice for the respondents. In the instant petition, petitioner has prayed for the following relief;- " For issuance of a writ in the nature of mandamus directing and commanding the respondents to make payment of medical bills( Expenses) of petitioner's wife ( cancer Patient) of

Patna High Court CWJC No.1615 of 2021(2) dt.24-01-2022 2/3 Rs. 1,33,583/- and Rs. 60,612/- I.e total Rs. 1,94,195/- to the petitioner along with admissible compound interest as under compelling circumstance for making treatment of petitioner's wife namely Pramila Devi in "rajiv Gandhi Cancer Institute, New Delhi and Mahabir Cancer Sansthan Phulwarisarif, Patna post approval has been given by the competent authority but till date the amount of the aforesaid medical bills (expenses) of petitioner's wife was not paid to the respondents.

Short question for consideration in the present petition is whether the petitioner is entitled to medical reimbursement as claimed in his representation dated 04.01.2019 or not? Whenever the competent authority is in receipt of any representation the same is required to be examined in the light of the service record and other material information and to redress the grievance of an employee. Speaking order be passed as to whether he is entitled to medical reimbursement as claimed by him or not. It he is otherwise legible amount shall be paid. Therefore the concerned respondents as hereby directed to pass order of medical reimbursement the same shall be paid along with interest @ 6% within the period of three months from the date of receipt of this order.
