Petitioner seeks bail in a case registered for the offences punishable under Sections 364, 302, 379 and 34 of the Indian Penal Code.

Vide Annexure-2, initially, an U.D. case was lodged after notice of the dead body of Sintu Kumar, the son of the informant. The informant specifically stated that he had no suspicion against anyone. After eight days, initially, a complaint case was filed by the mother of the deceased alleging therein that she has suspicion that the petitioner had murdered. Learned counsel for the State submits that on perusal of the case diary reveals that there is no eye-witness of the occurrence.

No.16654 of 2017 (3) dt.16-05-2017 2/2 Considering the fact that only suspicious material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/successor Court in connection with Amarpur Police Station Case No. 105 of 2015 corresponding to G.R. Case No. 732 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
