JUSTICE BIRENDRA KUMAR ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 341 /342 /323 /324 /307 /364A /120B of the Indian Penal Code.

As per F.I.R. the son of the informant was allegedly kidnapped by four unknown persons in presence of the informant. Co-accused Raj Mangal Sah confessed before police that he and others had kidnapped the victim.

Submission is that the victim has already been recovered. No statement under Section 164 Cr.P.C. has been recorded up till now. Similarly situated co-accused Rama Shankar Rai has already been allowed bail by a coordinate Bench of this

Patna High Court Cr.Misc. No.10376 of 2017 (2) dt.18-03-2017 2/2 Court in Cr. Misc. No.11721 of 2017.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar, Motihari/Successor Court, in connection with Rajepur P.S. Case No.136 of 2016.
