JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 This application, for grant of anticipatory bail, arises out of Sasaram Nagar P.S. Case No. 844 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code. Prosecution case is that son of the informant was found dead in suspicious condition in the hostel building and petitioner being Headmaster of the school has been made accused along with others.

Submission of learned counsel for the petitioner is that he is not the In-charge of the hostel rather one Jitendra Kumar Kushwaha is the In-charge of the hostel and further the CCTV footage disclose that the deceased entered inside the room with rope as such, he died due to hanging. Further submission is that the petitioner was not present at the place of occurrence rather he was at Kota, Rajasthan in connection with admission of his son in the

Patna High Court CR. MISC. No.36686 of 2019(4) dt.18-09-2019 2/2 school.

Having heard both sides, considering the facts and circumstances, let the petitioner, above named, surrender in the court below within two weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram (Rohtas), in connection with Sasaram Nagar P.S. Case No. 844 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is further subject to the condition that petitioner will cooperate in investigation of case and make himself available as and when required, otherwise, his bail bond will be cancelled.
