The present petition has been preferred for the following reliefs:- (i) for issuance of a writ in the nature of Certiorary or any other appropriate writ/order/ direction to quash/Set-aside the order of mutation case no 1396/2022-2023 dated-08.11.2022 passed by the Circle officer, Karapi district Arwal (Respondent No.-4) whereby and where-under it has been ordered that the Mutation case is accepted and land mutate to wrong person those who have not title right of the land, prior to this

Patna High Court CWJC No.10296 of 2023(2) dt.29-04-2024 2/2 order same circle officer dated 17.08.2022 rejected the mutation case no. 1284/2021-2022 on the ground of lack of evidence;

(ii) further, for issuance of a writ in the nature of Mandamus or any appropriate writ/order/direction to the D.C.L.R Arwal (respondent No.-3) to decide the mutation Appeal No. 41/2022 expeditiously which is pending.

3. A perusal of the prayer would show that the petitioner wants setting aside of the mutation order dated 08.11.2022 in Mutation Case No. 1396 of 2022-23.

4. Further perusal of the annexure would show that Arvind Kumar (vendee) as also Ramanuj Sharma, Santosh Kumar, Sanjay Kumar and Ramvinay Singh who are the vendors and cousin brothers of the petitioner have not been made party-respondent.

5. In that background, when the necessary parties have been deliberately left out, the writ petition is fit to be dismissed for non-joinder of the necessary parties.

6. Accordingly, the same stands dismissed.
