JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 394 of the Indian Penal Code.

Prosecution case is that informant was sitting in a shop and owner of the shop had gone for some work. In the meantime, some miscreants came on motorcycle and looted the box containing money from the shop and fired shot which hit informant's elbow.

It has been submitted on behalf of the petitioner that he is in custody since 10.5.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. He has not been put on T.I.P. There is no recovery of any incriminating article from the possession of the petitioner. It is further submitted that petitioner may be released after completion of six months in custody, i.e., from 10.5.2016. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.33272 of 2016 (3) dt.23-09-2016 2/2 above named petitioner be released on bail after completion of six months in custody, i.e., from 10.5.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Vaishali at Hajipur, in connection with Mahnar P.S. Case no. 96 of 2015.
