JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Kurtha P.S.Case No. 05 of 2016 for the offences under Sections 328 and 394 of the Indian Penal Code.

In this case vide order dated 23.03.2017 case diary was called for.

Learned counsel appearing on behalf of the State on the basis of the case diary submits that out of three accused in their confessional statements, one has not named the petitioner. Accused, who disclosed the name of the petitioner in his confessional statement, namely, Kamlesh Paswan has been granted bail by a bench of this Court vide order dated 28.02.2017 in Cr. Misc. No. 9172 of 2017.The petitioner is in custody since

Patna High Court Cr.Misc. No.13655 of 2017 (4) dt.31-05-2017 2/2 04.01.2017.

In view of the above fact let above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Arwal in connection with Kurtha P.S.Case No. 05 of 2016 on the condition that he will extend full co-operation in the trial and he will not, in any manner, influence the evidence or the witnesses.
