JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 06-09-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Ladaniya P.S. Case No. 249 of 2020 registered for offence punishable under sections 341, 323, 307, 324, 504 and 506 of the Indian Penal Code.

The allegation against the petitioner is that he assaulted the informant and his son, wife and father.

The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and the injuries are simple in nature, to which the learned counsel for the informant submits that the petitioner has badly assaulted the informant and his family members.

Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let him, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Madhubani in connection with Ladaniya P.S. Case No. 249 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

The petitioner shall file an affidavit with the averment that he shall not be indulged in similar type of occurrence. If it comes to the notice of the learned court below that the petitioner is involved in any other case except present one, the learned court below will be at liberty to cancel his bail bond. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
