1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code as well as Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 14.02.2024. It is further submitted that Arif @ Sona @ Arif Mahtab @ Aarif @ Aarif Mahtab had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 44362 of 2024 and the same was allowed by an order dated 31.08.2024. It is next submitted that petitioner is similarly situated like Arif and while granting anticipatory bail to Arif this Court had

Patna High Court CR. MISC. No.41964 of 2024(3) dt.21-09-2024 2/2 considered the case on merits and thereafter anticipatory bail was granted to him. It is also submitted that the case of the petitioner is akin to Arif and thus seeks bail.

4. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant opposed the prayer for regular bail of the petitioner but then learned counsel appearing on behalf of the informant fairly submits that the case of the petitioner is similar to that of Arif.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gopalganj (Town) P.S. Case No. 118 of 2024.
