Petitioner apprehends his arrest in connection with Rahika P.S. Case No.49 of 2023 dated 17.03.2023, registered for the offence punishable u/s 341, 323, 363, 366(A), 504 of the IPC, pending in the Court of learned C.J.M., Madhubani. 3.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek

Patna High Court CR. MISC. No.42998 of 2023(2) dt.10-08-2023 2/2 regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering this fact that petitioner and the victim have solemnized marriage and both are residing together.
