2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 8/20(b) (ii), (B) of the NDPS Act.

3. It is alleged that 1.250 kg contraband Gaanja was recovered from the bush behind the house of the petitioner.

4. It is submitted that petitioner has been made accused in this case only on the basis of suspicion. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Gopalganj in connection with Thawe P.S. case No. 360 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
