The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 406, 467, 468 and 471/34 of the Indian Penal Code. It is alleged that at the sugar cane purchase centre of Bishnu Sugar Mill, Gopalganj sugar cane were being purchased but genuine receipts were not being issued. Moreover, there was interpolation with regard to the actual weight of the sugar cane. The petitioner was working as a contractor at the said sugar cane purchase centre.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.46777 of 2014 (02) dt.24-04-2015 2/2 petitioner that there is nothing on the record to suggest that petitioner was involved in any manner or controlling over the said sugar mill. There is also nothing on the record to suggest that the petitioner was incharge at purchase centre or in any way the informant was being cheated by this petitioner. The actual date of occurrence has not been mentioned in the first information report.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Kalyanpur P.S. Case No. 192 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
