Petitioner seeks bail in a case, initially, registered for the offences punishable under Section 365 of the Indian Penal Code and later on, Sections 302, 201, 34 of the Indian Penal Code were also added.

Petitioner is named in the first information report with accusation that he took the deceased from his house and subsequently, the dead body of the deceased was recovered. The impugned order goes to show that none has seen the actual killing of the deceased and except circumstantial evidence, there is

Patna High Court Cr.Misc. No.36943 of 2016 (2) dt.01-09-2016 2/2 nothing against the petitioner, who is languishing in jail custody since 30.06.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Hilsa P.S. Case No. 46 of 2015.
